Binding rules to prevent the misuse of reporting functions on social media platforms

Reporting and complaints functions on social media platforms are important for reporting genuine breaches of the law and platform rules. However, they must not be misused as a tool to put pressure on other users out of personal animosity, political opposition or to harass them.

We therefore call for binding standards to prevent the misuse of reporting functions.

Specifically, we call for:

• clear criteria for identifying abusive reports

• a warning in the event of repeated, manifestly unfounded reports

• a temporary restriction or suspension of the reporting function in the event of further abuse

• stronger measures in the event of systematic or coordinated abuse

• transparency towards those affected

• protection for honest and bona fide reports

Reasoning

Unfounded or abusive reports can have significant consequences. Content is temporarily restricted, accounts are investigated, and those affected must lodge an appeal, thereby investing time, reach and trust.

Even if content is later restored, the damage often persists.

The problem is not only a burden on individuals, but also undermines trust in the platforms’ moderation systems. Reporting systems are intended to protect the community — not to be used as a means of exerting pressure against unwelcome opinions, individuals or organisations.

The legal framework already exists: Article 23 of the Digital Services Act (DSA) provides for measures against individuals who frequently submit reports that are manifestly unfounded. What has been lacking so far are clear, transparent and consistently applied standards that users can understand.

This petition is not directed against legitimate reports. Anyone who reports a possible breach in good faith must not be disadvantaged as a result.

It concerns exclusively the repeated and recognisable abuse of reporting functions.

Objective

We want:

• fair procedures

• transparent rules

• effective protection against abuse

• a digital environment in which freedom of expression, legal certainty and fairness are equally protected

Concluding statement

Reporting should once again mean: ‘I believe there really is a breach here.’ And not: ‘I don’t like this person or their opinion.’

That is why we are now calling for binding rules against the misuse of reporting functions on social media.
