Falls Ihre Auführungen bezüglich psychischer Störungen von Menschen, die Tiere quälen, zutreffen sollten (was ich nicht beurteilen kann und will), würde dies so, wie Sie es beschreiben, zur SCHULDUNFÄHIGKEIT führen (§ 20 StGB). Somit wäre eine Bestrafung nicht möglich, sondern lediglich die sog. "Maßregel" einer Unterbringung in einer psychiatrischen Klinik (§ 63 StGB). Außerdem kann ich Ihrem Text nicht entnehmen, in bezug auf welche Tiere dies gelten soll - wohl hoffentlich nicht für das absichtliche Zerquetschen oder Zertreten einer Fliege, Stechmücke oder Kakerlake.
