New York Sports Books has to wait until 2024 for Gaming

New York's sportsbook operators will be disappointed to hear that online gambling has not been cut, and there is a growing possibility that it will not be introduced this year. You may recall that the March 7, 2023 iGaming Roundtable hearing included lawmakers and industry experts hoping to ease ongoing concerns from the Hotel & Gaming Trade Commission about land-based cannibalization and its impact on live dealer union jobs in the state. However, these concerns still remain and remain valid.

Senator Joe Adabo was one of those disappointed that iGaming was not included in the one-house budget. He told Empire State that legalization of online gambling is inevitable. He noted that things could develop quickly in Albany, but that he was no longer talking about them, and that he could never know. He added that something stranger happened in the budget negotiations.

Meanwhile, Rep. J. Gary Pretlow noted that his game plan was for a post-budget session. This could include a potential extension of sports betting to add awards and drafts. He shared that he does not expect iGaming to be included outside of the budget because it is fiscal-related, and that it could only happen if the state urgently needs $1 billion.

In addition, Mr. Pretlow does not expect a middle ground to include promotional deductions for operators. Even though no one was a fan of it, they insisted that they would not actually have a hard time because the market has been running for a year and there are no businesses out of business.

This leaves the DraftKings and eight other operators brainstorming about their future in the state. The company's CEO said Empire State is the largest jurisdiction over sports betting and may be profitable, but not all operators are profitable. This could potentially be bad news for betting people, as SportsBooks have warned they may offer worse odds in the state.

Earlier this month, New York State Representative David Waffrin introduced resolution A5923. If passed, the bill would change the state constitution to allow sports books on thoroughbred and stable racetracks. Therefore, it allows purebred and stable racetracks and simulcast theaters to join the state's rapidly expanding sports betting market.

New York's sports betting landscape is likely to move further in the next year or two, as the state is considering awarding three Downstate Casino licenses to allow sportsbook operations. In January, the Game Facilities Location Committee began the application request process, and the three winning bids will be announced at the end of 2023.
