This report summarizes game-related regulations and laws in six Western European countries, including the UK, Germany, Belgium, the Netherlands, Spain, and France. ▲Grade classification ▲ Standard terms and conditions ▲ Protection of minors ▲ Protection of personal information ▲ Payment and refund, as well as game contents and advertising expressions that should be noted according to the culture and history of each country.
First, in common with each country, there was no obligation for foreign operators to obtain special permission, designate a local agent, or install servers in the country in order to operate the game business. Regarding the classification of grades, the UK, Germany, and France are only obligated to games that provide physical objects such as disks, and other countries do not have legal obligations for games distributed online and mobile.
There were also social and cultural taboos in the game content. In Germany, it is typical that content that glorifies or justifies Nazi symbols or actions committed under the Nazis is not allowed. In addition, content such as hatred, defamation, and child sexual abuse of individuals and groups is prohibited in all countries.
In the case of probability-based items, the UK, Germany, Spain, the Netherlands, and France are found to have no regulations stipulated by law, while Belgium legally prohibits probability-based items. Play to Earn (P2E) games were not subject to separate regulations in all six countries unless they were gambling.
In addition, there were no standard terms and conditions suggested by the government regarding game services, and the GDPR (the UK's own GDPR) is applied to personal information protection. Game advertisements are prohibited from misleading consumers. In particular, the UK needs to be careful by clearly notifying that the advertisement video is a directed video when it is not an actual play video.
Kang Shin-chul, president of the Game Association, said, "Through public-private cooperation, results are being made such as collecting information on overseas game markets and securing databases by each country and continent. We will continue to make efforts to help the association contribute to the development of the domestic game industry."
