Art. 3:4 van de Awb luidt: Artikel 3:4 1. Het bestuursorgaan weegt de rechtstreeks bij het besluit betrokken belangen af, voor zover niet uit een wettelijk voorschrift of uit de aard van de uit te oefenen bevoegdheid een beperking voortvloeit. 2. De voor een of meer belanghebbenden nadelige gevolgen van een besluit mogen niet onevenredig zijn in verhouding tot de met het besluit te dienen doelen.

Rechtmatigheid; evenwichtige belangenafweging

In het bestuursrecht staat het evenredigheidsbeginsel beschreven in art. 3:4 van de Algemene Wet Bestuursrecht (Awb). Het evenredigheidsbeginsel is onderdeel van de Alg. Beginselen van Behoorlijk Bestuur (ABBB). Rijkswaterstaat dient vooral de belangen van de scheepvaart. Hoe staat het met de belangen van de ± 16.000 fietsers e.a., die dagelijks langs de Korreweg fietsen of bewegen? Met name de mensen met een fysieke beperking. Toetst de gemeenteraad op dit genoemd beginsel?

Doelmatigheid

Indien een hoge GKB bijna net zo vaak open moet dan een lage GKB, gegeven de trend naar steeds grotere containerschepen voor de binnenvaart, dan is deze dure en hoge variant toch niet doelmatig? Toetst de gemeenteraad ook op doelmatigheid?

Ik wil het Gerrit Krolbrugcomité de volgende aanbeveling geven: stel dat de gemeente Groningen een nieuwe hoge GKB zelf zal moeten betalen, die veel duurder is dan de lage variant, zal de gemeenteraad dan GEEN aandacht geven aan het kostenplaatje?
