Ovakva praksa u suprotnosti je s modelima koje primjenjuju razvijenije europske zemlje u koje strani radnici tradicionalno odlaze. U državama poput Njemačke ili Austrije djeca automatski ostvaruju pravo na zdravstveno osiguranje preko svojih roditelja, bez dodatnih financijskih nameta. Tamo nacionalnost djeteta nije presudna; ključno je jedino da dijete zakonito boravi na teritoriju države s roditeljem koji radi i plaća poreze.

​Ured Pravobraniteljice za djecu u svom je izvješću već ranije upozorio kako se roditelji djece koja nemaju hrvatsko državljanstvo redovito suočavaju s kršenjima njihovih osnovnih prava. Problemi najčešće počinju s reguliranjem boravišnog statusa i “spajanjem obitelji”, a kulminiraju zakonskim preprekama u zdravstvenoj zaštiti.
​”Godinama ukazujemo kako sva djeca na privremenom boravku u Hrvatskoj, neovisno o razlozima boravka, trebaju uživati jednaki standard zdravstvene zaštite te za to treba osigurati sredstva iz državnog proračuna.”, ističu iz ureda Pravobraniteljice.

​Hrvatska se trenutno oslanja na više od 100.000 stranih radnika kako bi održala gospodarstvo stabilnim i nadomjestila kronični nedostatak domaće radne snage. Ipak, dok su ruke stranih radnika i radnica dobrodošle na gradilištima, u ugostiteljstvu i na dostavama, sustav i dalje krši ljudska i socijalna prava članova njihovih obitelji i ne pruža socijalnu sigurnost, tako stavljajući one najosjetljivije, djecu stranih radnika, u poziciju građana drugog reda.

This practice stands in contrast to the models applied by more developed European countries that are traditional destinations for foreign workers. In countries like Germany or Austria, children automatically gain the right to health insurance through their parents, without any additional premiums. A child's nationality is not the deciding factor there; the only crucial requirement is that they reside legally in the country with a parent who works and pays taxes.

The Office of the Ombudsperson for Children has previously warned in its reports that parents of children with foreign citizenship regularly face difficulties in exercising basic rights. These problems often begin with the regulation of residency status and family reunification, culminating in legal obstacles regarding access to healthcare.
"For years, we have been pointing out that all children residing temporarily in Croatia—regardless of the reason for their stay—should enjoy the same standard of healthcare, and that funds for this purpose must be secured in the state budget," the Ombudsperson’s office emphasizes.

Croatia currently relies on more than 100,000 foreign workers to maintain economic stability and offset the chronic shortage of domestic labor. Yet, while their labor is welcomed on construction sites and in the hospitality and delivery sectors, the system continues to fail in providing basic human and social security for their families, effectively relegating the children of foreign workers to the status of second-class citizens.
