Straffälliges Verhalten hat Konsequenzen, aber nicht jede Straftat führt automatisch zur Abschiebung. Warum? 1. Die rechtliche Grundlage Wer eine schwere Straftat begeht, kann laut Aufenthaltsgesetz abgeschoben werden (§ 53 AufenthG). Das betrifft z. B. Gewaltverbrechen, Drogenhandel oder Serienstraftaten. Diese Regel wird auch angewendet: Jährlich werden tausende Menschen abgeschoben, darunter auch Straftäter. 2. Aber: Abschiebungen sind nicht immer durchführbar - Kriege, politische Verfolgung oder instabile Staaten (wie Syrien oder Afghanistan) machen Rückführungen oft unmöglich. - Ohne gültige Papiere oder bei fehlender Kooperation des Herkunftslandes kann keine Abschiebung erfolgen. - Menschen mit Familie, Ausbildung oder langer Aufenthaltserlaubnis werden oft differenziert behandelt – je nach Einzelfall. 3. Der Rechtsstaat schützt auch vor Willkür In Deutschland entscheiden Gerichte, Ausländerbehörden und das BAMF über Abschiebungen. Dabei gilt: Schutz vor Verfolgung, Folter oder unmenschlicher Behandlung steht über Abschiebungsinteressen – das entspricht der Genfer Flüchtlingskonvention und dem Grundgesetz.
