The petitioner complains about the absence of a harmonized definition of “disability” within the European Union. He calls for a holistic definition of the term, which would take into consideration disabilities that are not included in the International Classification of Diseases of the World Health Organization. The petitioner points out the fact that the lack of harmonization in this matter leads to a differentiated recognition of disabilities. As a result, some persons with disabilities are not eligible for support, although being in need of it. The petitioner claims that this situation prevents persons affected by unacknowledged disabilities to enjoy their fundamental rights guaranteed in the Charter of Fundamental Rights of the European Union
