On the alleged violation of Natura 2000 related EU-legislation and the threat to the habitats of rare species of golden eagle in the Mała Barania massif (Poland) 

The petitioner draws attention to alleged violations of the EU legal framework on habitats of important bird species during the marking out of the route for an express road in the Mała Barania massif. The petitioner claims that the environmental decisions required for this project did not take environmental factors into account, namely threats to the habitats of endangered species. A complaint sent to the Provincial Environmental Protection Inspectorate did not yield the desired results, as this body did not carry out the on-site inspections and in its decision, it stated that there was no evidence pointing to the violation of legislation related to habitats of important bird species. Furthermore, no consultations with nature institutions or organisations were carried out. The petitioner refers to Articles 11 and 13 TFEU relating to the protection of the environment and animal welfare, which should be taken into account in the implementation of EU policy and transport policy by Member States.
