The petitioner complains that Directive 93/13/EEC on unfair terms in consumer contracts has not been properly transposed into Hungarian law. According to the petitioner, a very large number of Hungarians took out foreign currency mortgages, but found themselves unable to pay back their monthly instalments because the banks applied for the repayment of the loan an exchange rate different from that used when the loan was made available. The petitioner states that this allowed banks to abusively terminate contracts and rendered hundreds of thousands of Hungarian homeless, which resulted in severe mental distress of those affected. Following a decision by the Court of Justice of the European Union as well as a decision by the Hungarian Supreme Court, which both declared such contractual terms as unfair, the Hungarian legislation was amended in 2014. However, the petitioner claims it provided no redress for debtors whose contracts had already been unlawfully terminated and who are now threatened by mass evictions.
